Q: Does it matter that I live in a different part of the country?

 

No. Where appropriate we will make visits to you.


Q: Will I have to visit a solicitors office?
 

 

You may visit the solicitor if you wish, however you will not be inconvenienced or expected to attend our offices.


Q: What entitles me to accident compensation?
 

 

If you have been injured in an accident that was wholly or partly not your your fault within the last three years, you could be entitled to claim . Please contact us for a free initial assessment.


 
Q: Should I visit my GP or go to hospital?
 
 

If you have been injured in your accident and would benefit from treatment or medical advice then you should see your GP/ go to hospital.


 
Q: What can I claim for?
 

 

There are two main heads of damage. Firstly, general damages, i.e. compensation for your injuries and their impact on your life . Secondly, special damages,i.e. compensation for out-of-pocket expenses such as medication, physiotherapy, loss of earnings, travelling expenses, vehicle repairs, damage to clothes etc


Q: How much is my claim worth?
 

 

This will depend on the medical evidence and how seriously you are injured and what out of pocket expenses you are incurring.


Q: How long will it take to settle my claim?
 

 

This will depend on the seriousness of your injuries. Relatively straightforward claims can settle within a few months, others take longer.


Q: Will I have to go to court?
 

 

Extremely unlikely . The vast majority of cases settle well before trial.


 
Q: How will I fund my claim?
 

 

Where possible, we will operate on a no win-no fee (conditional fee )basis. Acceptance of your claim on a no win-no fee basis is subject to the terms and conditions of the agreement you enter into, which will need to be discussed very carefully with you. In addition , there are other funding options open to you such as legal expenses insurance and private funding. Public funding through former legal aid is now virtually non-existent for personal injury claims. The different options will be discussed with you in greater detail after you have contacted us.


Q: Are there any time limits within which to bring a personal injury claim?
 

 

Yes. Generally, you have to issue court proceedings within three years of your accident. There is some limited discretion to extend this. (Issuing court proceedings is not the same as actually attending trial).

For minors, i.e. under 18, the limitation period runs from the age of 18 onwards.

If you're claiming under the CICA scheme for an injury suffered as a result of a criminal act the limitation period is shorter, namely two years (Northern Ireland has a different scheme).

Accidents overseas have different time limit. It should not be assumed that the same limitation period exists abroad as in the UK.

You should speak directly to your legal advisor as to what limitation applies to your specific case.
